Washington County Courthouse non-compliant signage

I reported the Washington county courthouse non-compliant signage in 2019 to the MS Attorney General.

The sign must state on the sign that the (no gun sign) is for regular permit holder only.... not for an Enhanced Firearm permit holder which can carry in a courthouse.

The sign was corrected back in 2019. Delta Democrat times had an article that I had complained about the sign. Mississippi county changes 'no-guns' sign at courthouse - Magnolia State Live

Now in 2023 the non-compliant sign returned, I had a Sheriff deputy try to deny me entry into the courthouse. (I have an Enhanced carry permit) I mentioned the issue to the Sheriff and board or supervisors with no immediate positive results. Sheriff allowed me to enter, it happened a second time with the deputy pointing to the no gun sign. I again called the sheriff who let me in the county courthouse. Sheriff failed to correct the signage issue.

I reported the signage issue to MS Attorney General’s office again. They investigated and found the signs are not in compliance again for the second time since 2019. Washington County MS has 30 days to correct or be in jepority of legal action.

Seems like they want to play games.

No after I explained the history and the law concerning the signage requiring the correct verbiage.
1)That it had been corrected back in 2019.
2)That the Sheriff was aware of the signage requirements since he was Sheriff when I had it corrected.
3)That the Boards President was aware since he was quoted in the news article back in 2019.
4) That the attorney for the county was present at the meeting and he should be aware of the law since I gave him a copy of everything.

After all that one of the Board of Supervisor’s expressed her feelings - she wanted to vote to keep the non-compliance sign. The President of the board calmed her down so she said on the record that she wanted to at least make her feelings known that she wanted to keep the current signage.

So it's been officially recognize for a second time by the MS Attorney General that they are not in compliance. It should be fixed with-in 30 days so I won't have standing or the need to sue. However I'll keep an eye on all the Washjngton County courthouses in each district from now on to ensure compliance. If the signs go back to (no guns) I believe this would just provide someone proof of possible legal action:

42USC1983 Civil action for deprivation of right.
18USC242 Depirvation of rights under color of law.
MS Code 97-1-1 Conspiracy - If two (2) or more persons conspire either: (c) or suit of any kind; or
  • (g) To overthrow or violate the laws of this state through force, violence, threats, intimidation, or otherwise; or
  • (h) To accomplish any unlawful purpose, or a lawful purpose by any unlawful means; such persons, and each of them, shall be guilty of a felony and upon conviction may be punished by a fine of not more than Five Thousand Dollars ($5,000.00) or by imprisonment for not more than five (5) years, or by both.

It's so plainly written what the signage needs.

I hope everyone keeps an eye on their county properties in your local areas to ensure compliance.

If you find a non-compliant sign the form is on the MS Attorney website. Takes a minute to submit the form along with a picture of the sign. The investigator has 30 days to investigate. Mine got it done in a week or so. If found not in compliance the county has 30 days to correct.

Pretty simple procedure.

Well I got a response finally from the Washington County lawyer today. (As mentioned earlier in post the MS Attorney Generals office rendered an opinion in a letter dated June 22, 2023)

It is thus the opinion of this office that because the subject sign located at the Washington County Courthouse does not provide that carrying a firearm is unauthorized only for license holders without a training endorsement, it is in violation of Section 45-9-53(4)(a) of the Mississippi Code. As such, the signage must be modified to comply with Mississippi law.

Section 45-9-53(5)(b) provides that the county shall have thirty (30) days to cure any violation found by the Attorney General’s Office in its investigation of a gun complaint. Further, “f the county or municipality fails to cure the violation within that thirty-day time period, a suit under paragraph (a) of this subsection may proceed.”

Please be advised that the Board of Supervisors did authorize the removal of the sign on the ground it did not conform to State law. New signage may be posted once approve by the Board.

I added the Mississippi Governor’s office to my response - just to be sure the Governor knows how Washington County is following MS Law or in this case not following the law:

Thank you for the update.

In the meantime please consider posting a temporary xerox sign stating Enhanced Carry allowed in Courthouse.

We wouldn’t want to continue to “ Chill ” the rights of the various MS Enhanced Carry permit holders.
